Terms and Conditions

The purpose of the following Terms and Conditions is to establish binding terms between Disanvel ("I", "Artist"), and users ("you", "Client") of my custom illustration services ("commission", "artwork"). Take in mind that these T&C are subject to change.Please read carefully.As the Artist, I reserve the right to decline any kind of request that implies content that makes me uncomfortable.

File properties

The Client will get two versions of their commissioned artwork:
1. A full resolution version
2. A smaller, public version with a "commission" watermark.Both versions will have an image format (i.e. jpg, png, gif) depending on the kind of commission being made, with a 300 dots per inch resolution and in RGB mode, unless the Client states otherwise.

Permissions and usage rights

  1. I reserve the right to post the public version of the commissioned artwork (if the privacy fee is not paid).

  2. I reserve the right to use discarded sketches, for personal or commercial use.

  3. I own the property rights to your commissioned artwork only as an artwork itself, I will not claim ownership over any subjects or characters depicted in the artwork.

  4. All rights not expressly granted in this page are retained by the Artist.

  5. The Client is not allowed to claim ownership, or copyright over the artwork.

  6. The Client must let me know if they want to be credited anonymously or if it’s necessary to post their commissioned artwork after a certain date.

  7. Only the Client and the Artist can grant usage permissions to third parties, except for profit or the prohibited clauses mentioned below.

Personal use (default)

  1. The Client is allowed to post their commissioned artwork with credits (i.e. “By Disanvel”).

  2. Printing is ok as long as it is not used for profit.

  3. The Client is not allowed to delete my watermark.

  4. Tracing my art or using AI image generators with it is prohibited in any way.

Commercial / monetized use (requires fee)

  1. The Client can reproduce and sell their commissioned artwork.

  2. Reselling as a NFT is prohibited.

  3. Fee starts from +100%, it can increase depending on its usage.

Payment

  1. Prices shown are base prices, these could increase based on the complexity of the commissioned artwork.

  2. Payment will be split into two parts; the first will be required to begin the sketching phase and the last to deliver the finished artwork.

  3. The full price could be covered in one upfront payment if the Client and the Artist consider it appropriate.

  4. The finished artwork will be sent to the Client through mail or a download link, it's their responsibility to download it before the link expires.

Deliver time

  1. According to its complexity, the approximate elaboration time could vary between 10-30 business days once the commissioned artwork is started.

  2. I reserve the right to work on other commissioned artworks if the Client's response time is long.

  3. The elaboration time could be affected according to the Client’s response time and the revisions requested.

  4. In case of any difficulty, I will keep the Client updated about their commissioned artwork progress.

  5. I will keep the Client informed about the progress directly and through my queue. Nevertheless, the Client could ask for updates personally if they desire.

Revisions and changes

  1. The following doesn't apply to "Surprise Me / Skeb style" commissions as they have their own policies and are subject to artistic freedom.

  2. It’s important that the Client brings the necessary references for the work demanded, being as clear as possible to avoid conflicts, since there are no refunds once the commissioned artwork is started.

  3. Once the commissioned artwork is finished and approved by the Client, no further changes will be made.

  4. It is the Client’s responsibility to ask for major changes at early stages (sketch and lines), otherwise, major changes will be charged at advanced stages.

  5. Minor changes are free. These are considered as changes that do not imply redrawing a significant part of the artwork and/or are misinterpretations by myself. (i.e. wrong facial features, hair length, base colors, materials).

Cancellations and Refunds

  1. The client may cancel the commissioned artwork before the first payment is made. Once the payment has been made and the commissioned artwork has been initiated, there are no refunds.

  2. If the client does not complete the payment in due time and form, or if they remain uncommunicated for more than six months, only the paid work will be delivered (i.e. if the payment was divided in halves and only the first half was paid, only the sketch will be delivered).

  3. Once the commissioned artwork is done and delivered, there are no refunds of any kind in the future.

  4. Refunds are only available under extreme circumstances in which I will not be able to complete the commission (e.g. file loss, work equipment loss, accidents, natural disasters). Only under these circumstances will I be able to offer a refund, or else, I could start your commission again. Thanks for your understanding beforehand!

Blacklist

Both the Client, as well as me, the Artist, will make every effort to avoid any kind of conflicts in the artwork process or after its delivery. If the Client goes against any of the terms or conditions mentioned on this document and/or causes a conflict without any interest to solve it, they will be blacklisted from future business and may be confronted legally, depending on the severity of the transgression.

By asking for a commission, you are responsible to comply with each point listed above. If you have any doubt outside the points covered in this document, please ask me about it, it would be a pleasure to help you.
